Our store is powered by Shopify, which enables us to provide the Services to you.

By accessing or using our Services, you agree to be bound by these Terms & Conditions (“Terms”), together with our Privacy Policy. If you do not agree, you must not use our Services.

 

1. ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your jurisdiction and that any information you provide (including email, billing, payment and shipping details) is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and all activity under your account. You may not transfer or sell your account.

4. HOW THE CONTRACT IS FORMED

4.1 When you place an order, you will receive an Order Confirmation acknowledging receipt. This does not mean your order has been accepted.

4.2 Your order is accepted only when we send a Dispatch Confirmation.

4.3 We may ship items separately.

4.4 By placing an order, you confirm that:

• you are legally capable of entering into binding contracts;
• you are purchasing as a consumer.

4.5 If there is any issue with your delivery upon arrival, you must contact us before unloading any items.

4.6 Customers may return goods at their own expense within 7 working days from the day after delivery. A minimum return charge of £130 applies. Items must be in their original condition.

 

5. OUR PRODUCTS

5.1 Many of our products are naturally sourced. Variations in colour, texture, and shape are normal and expected.

5.2 Product images are for illustrative purposes only. Colours may vary depending on your device.

5.3 You are responsible for ensuring the product is suitable for your intended use, including size and fit.

 

6. CARING FOR OUR PRODUCTS

We do not accept liability for damage caused by failure to follow care instructions. Weather exposure may cause fading or discolouration; this is not considered a defect.

 

7. AMENDMENTS TO PRODUCTS

We may make changes to products to comply with legal or regulatory requirements. We may also amend product designs or packaging. If a design changes after you place an order, you will be notified and may cancel.

 

8. DELIVERY

8.1 Delivery information is available on our Delivery page.

8.2 Delivery times are estimates only and not guaranteed.

8.3 We are not liable for delays caused by carriers, traffic, weather, customs, or events outside our control.

8.4 Delivery costs vary by location.

8.5 Re‑delivery charges may apply if delivery cannot be completed (e.g., no one available to sign, unsuitable access).

8.6 All products are delivered on pallets or crates. Delivery is kerbside only. Moving items beyond this point is your responsibility.

 

9. RISK AND TITLE

Risk passes to you upon delivery.
Ownership passes only when we send the Dispatch Confirmation and receive full payment.

 

10. PRICES AND PAYMENT

10.1 Prices are shown on each product page and include delivery costs at checkout.

10.2 Prices may change at any time.

10.3 If a pricing error occurs, we will contact you before dispatch or reject the order.

10.4 If the correct price is lower, you will be charged the lower price.
If higher, we may request additional payment or cancel the order.

10.5 We are not obliged to supply a product at an incorrect price if the error is obvious.

10.6 Payment must be made by credit or debit card. We do not accept PayPal.

10.7 All card payments are subject to authorisation. We are not liable for delays caused by payment refusal.

 

11. RETURNS, CANCELLATIONS & FAILED DELIVERIES

11.1 Failed Deliveries

A minimum charge of £130 applies if delivery fails due to:

• unsuitable access
• raised curbs
• blocked access
• no one available to sign
• steep hills preventing unloading

11.2 Cancellations Before Dispatch

You may cancel your order at least 48 hours before dispatch.
Cancellations must be made by email during business hours.

11.3 Cancellations After Dispatch

If an order is cancelled while in transit, a minimum charge of £130 per pallet applies.

11.4 Returns

Returns must be made within 7 working days at your own expense. Items must be in original condition.

 

12. THIRD‑PARTY TOOLS & LINKS

We may provide access to third‑party tools or links. These are provided “as is” and at your own risk. We are not responsible for third‑party content, accuracy, or services.

 

13. PRIVACY POLICY

Your personal information is handled in accordance with our Privacy Policy.

 

14. FEEDBACK

By submitting feedback, you grant us a perpetual, worldwide, royalty‑free licence to use it for any purpose. You must own the rights to any feedback you submit.

 

15. PROHIBITED USES

You may not use the Services for unlawful, harmful, fraudulent, or abusive purposes, or to interfere with the operation of the Services. We may suspend or terminate your access for violations.

 

16. TERMINATION

We may terminate your access at any time. Sections relating to intellectual property, liability, indemnification, governing law and other continuing obligations survive termination.

 

17. DISCLAIMER OF WARRANTIES

Products and Services are provided “as is” and “as available”. We do not guarantee uninterrupted or error‑free operation.

 

18. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we are not liable for indirect or consequential losses, including loss of profits, business, savings, or data.
Nothing limits liability for death or personal injury caused by negligence, fraud, or any matter that cannot legally be excluded.

We do not reimburse tradesman or installation costs under any circumstances.

 

19. INDEMNIFICATION

You agree to indemnify Erth Stone against claims arising from your breach of these Terms or your misuse of the Services.

 

20. EVENTS OUTSIDE OUR CONTROL

We are not liable for delays or failures caused by events outside our reasonable control, including strikes, natural disasters, transport failures, or government restrictions.

 

21. SEVERABILITY

If any provision is found invalid, the remainder of the Terms remain enforceable.

 

22. WAIVER; ENTIRE AGREEMENT

Failure to enforce any right does not constitute a waiver.
These Terms constitute the entire agreement between you and us.

 

23. ASSIGNMENT

You may not assign your rights under these Terms. We may assign our rights without notice.

 

24. GOVERNING LAW

These Terms and any disputes arising from them are governed by English law.
You and Erth Stone submit to the exclusive jurisdiction of the courts of England & Wales.

 

25. CHANGES TO THESE TERMS

We may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
